This Privacy Policy explains how Statewide Properties LLC, a licensed New York real estate brokerage doing business as FlatFeeMLSNY.com ("Company," "we," "us," or "our"), collects, uses, shares, and protects information when you visit flatfeemlsny.com (the "Site") or use our flat fee MLS listing services (the "Services").

Because we operate as a real estate brokerage, some information you give us — most importantly your property details and photographs — is collected specifically so it can be published publicly on the MLS and syndicated to real estate websites. Sections 2 and 3 below explain exactly what becomes public and what stays private.

1. Information We Collect

• Contact information: your name, email address, phone number, and mailing address, provided when you fill out our get-started, renewal, change-request, contact, or bug-report forms.
• Property information: address, price, description, features, disclosures, and other details you submit about the property being listed.
• Photos and documents: property photographs and proof-of-ownership documents (such as a deed or tax bill) you upload to support your listing.
• Payment information: handled directly by our payment processor, Stripe. We receive confirmation that payment was made but do not store your full card number.
• Communications: messages you send through our contact form, bug-report form, change-request form, or our on-site AI assistant ("Hannah").
• Usage and device data: IP address, browser type, pages visited, and similar analytics data collected automatically via cookies and analytics tools.
• Referral source: how you told us you heard about us, if you provide it.

2. What Becomes Part of Your Public Listing

Once your listing goes live on the MLS, the property details and photographs you submit are published on the MLS and syndicated to third-party real estate websites (such as Zillow, Realtor.com, Trulia, Homes.com, Redfin, and Apartments.com), where they are publicly visible to anyone browsing those sites.

Your phone number and email address are not published on your public listing. Buyer's agents can see your contact information in the MLS showing instructions, and we share your contact information with a specific prospective buyer or agent when they reach out to us about your property.

3. How We Use Information

• To prepare, enter, and manage your MLS listing and generate your listing agreement for e-signature.
• To process payment for your plan, extra edits, and add-ons.
• To send transactional emails — order confirmation, a copy of your signed listing agreement, renewal and expiration reminders, and follow-ups on incomplete listing submissions.
• To respond to contact requests, bug reports, and change requests.
• To provide context to our AI assistant so it can answer your questions about pricing or your submission.
• To detect fraud, prevent abuse, and enforce our Terms of Service.
• To comply with recordkeeping obligations applicable to licensed New York real estate brokerages.

4. How We Share Information

We do not sell your personal information. We share information only as needed to operate the Services:

• MLS and syndication partners — property details and photos, as described in Section 2.
• Showing-coordination provider — to route buyer/agent showing requests and, where applicable, your contact information.
• Payment processor (Stripe) — to process your payment.
• E-signature provider — to deliver and execute your listing agreement.
• Hosting, database, and email infrastructure providers — to operate and secure the Site and send transactional email.
• AI service providers — conversation content you send our AI assistant is transmitted to the underlying language-model provider to generate a response.
• Analytics providers — aggregated or pseudonymous usage data, to understand and improve the Site.
• Legal and safety — if required by law, subpoena, or to protect our rights, users, or the public.
• Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.

5. Cookies and Analytics

We and our analytics providers use cookies and similar technologies to keep the Site functioning, remember preferences, and understand how visitors use the Site. You can control or disable cookies through your browser settings; doing so may affect some Site functionality.

6. Data Retention

We retain listing records, signed agreements, and related transaction communications for as long as required by New York real estate licensing and recordkeeping rules, and other personal information for as long as reasonably necessary for the purposes described in this Policy or as required by law.

7. Your Privacy Choices

You may ask us to access, correct, or delete the personal information we hold about you, or to opt out of marketing emails, by contacting us using the information in Section 11. We will honor such requests except where we need to retain information to complete an active listing, meet a legal or recordkeeping obligation, or resolve a dispute. If you are a California resident, you may have additional rights under the CCPA/CPRA, including the right to know, delete, and correct your personal information; we do not sell or share personal information for cross-context behavioral advertising.

8. Data Security

We use reasonable administrative, technical, and physical safeguards to protect the information we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

The Site and Services are intended for adults 18 and older and are not directed to children. We do not knowingly collect personal information from anyone under 18.

10. Third-Party Links

The Site links to third-party websites (such as MLS syndication partners) that have their own privacy practices. This Policy does not apply to those third-party sites, and we encourage you to review their privacy policies.
